From clients engaging our services:

  • Settlement dates and purchase-related information
  • Pre-inspection briefing notes and priorities you provide to us
  • Correspondence between you and ClearAsset

During the provision of services:

  • Video walkthroughs and photographs of your property taken at inspection
  • Written inspection notes and documentation
  • Defect records and follow-up correspondence with developers or their representatives

From website visitors:

  • Name and contact details submitted via our contact form
  • Technical information including IP address, browser type, and pages visited (collected automatically via cookies — see Clause 10)

We do not collect sensitive information (such as health information, financial account details, or government identifiers) unless you provide it voluntarily and it is directly relevant to delivering our services.

We collect personal information:

  • Directly from you, when you contact us, complete an enquiry form, participate in a discovery or briefing call, or sign a Service Agreement
  • During the delivery of our services, including at pre-settlement inspections
  • Automatically via our website through cookies and standard web hosting logs

We collect personal information only for the purposes of:

  • Providing buyer representation and settlement coordination services
  • Communicating with you about your engagement and upcoming inspections
  • Producing and delivering inspection documentation (video walkthroughs, photographs, and written notes)
  • Coordinating with third party service providers on your behalf (see Clause 6)
  • Issuing invoices and managing our business records
  • Responding to enquiries submitted through our website
  • Improving our website and services

We will not use your personal information for any purpose unrelated to the above without your consent. 

  1. How We Use Your Information

Your personal information is used only by ClearAsset and authorised third parties (see Clause 6) for the purposes outlined in Clause 4.

We do not sell, rent, or trade your personal information to any third party.

Where you have consented to receiving marketing communications from ClearAsset, you may opt out at any time by contacting us at info@clearasset.com.au or by using the unsubscribe link in any marketing email. We will action opt-out requests promptly.

  1. Sharing Your Information

We may share your personal information with third parties only where necessary to deliver your services. This includes:

  • Independent building inspectors — to coordinate your inspection appointment
  • Property managers — where you have requested assistance with property management referrals or introductions
  • Accountants or bookkeepers — for business record-keeping purposes only (limited to financial transaction data)
  • IT and software providers — who assist us in operating our business securely (subject to confidentiality obligations)

Overseas disclosure:

Some of our clients are based overseas. Where you are located outside Australia, your personal information may be held or processed in Australia. We take reasonable steps to ensure that overseas handling of your information meets a standard comparable to the Australian Privacy Principles.

We do not share your personal information with overseas third parties unless required to deliver your services (for example, communicating with you via email or video call platforms) or unless you have provided your consent.

7.1 We take reasonable steps to protect personal information from misuse, interference, loss, unauthorised access, modification, or disclosure. These steps include:

  • Storing client files and correspondence in password-protected systems
  • Limiting access to personal information to authorised personnel only
  • Using secure methods for transferring documents and inspection materials

While we take these precautions, no method of electronic transmission or storage is completely secure. We cannot guarantee the absolute security of information transmitted to us via email or our website contact form.

7.2 In the event of a data breach that is likely to result in serious harm to any individual whose information is affected, ClearAsset will notify affected individuals and the Office of the Australian Information Commissioner as required by the Privacy Act 1988 (Cth) Notifiable Data Breaches scheme. 

    1. How Long We Keep Your Information

    We retain personal information only for as long as necessary to fulfil the purposes for which it was collected, or as required by law.

    You may request earlier deletion of your inspection documentation at any time by contacting us (see Clause 12). 

  1. Accessing and Correcting Your Information

You have the right to request access to the personal information we hold about you and to ask us to correct any information that is inaccurate, incomplete, or out of date.

To make an access or correction request, please contact us in writing using the details in Clause 12. We will respond within 30 days. In some circumstances we may be unable to provide access (for example, where doing so would unreasonably affect the privacy of another person), and we will explain why if that is the case. We do not charge a fee for access requests.

  1. Cookies and Website Tracking

Our website uses cookies — small data files stored on your device — to improve your browsing experience. Cookies may be used by:

  • Our website platform, for basic site functionality
  • Embedded content providers (such as YouTube or Google Maps) which may set their own cookies
